The Firm successfully defended our clients in binding arbitration and defeated all claims for breach of contract, intentional and negligent misrepresentation, unfair business practices, unjust enrichment, express indemnity, Civil RICO, and intentional and negligent infliction of severe emotional distress, with claimants’ requesting damages at the close of the case in excess of $62 million. In the months leading up to arbitration, claimants refused to attend mediation, refused to make any settlement demand or offer and insisted that the Firm’s clients accept that the case was worth eight figures. The Firm’s pre-arbitration motion resulted in several claims being dismissed and additional claims were dismissed at the close of claimants’ case in chief. After a seven-day arbitration hearing in February and simultaneous closing briefs and rebuttal briefs in April, the arbitrator found in favor of the Firm’s clients on all issues, found our clients to be the prevailing party and awarded claimants nothing. The Firm’s Shane Biornstad took the lead in the arbitration proceedings, which were conducted at JAMS in Irvine, California.
